1. Acceptance of Terms

By accessing or using Aleph Terminal ("Service"), including by connecting a cryptocurrency wallet, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Aleph Terminal is a cryptocurrency market intelligence and analytics platform that provides data visualization, market indicators, algorithmic signal generation, strategy backtesting tools, and related informational services. The Service is a SOFTWARE TOOL that processes and displays market data. The Service does NOT provide investment advice, financial advice, trading advice, or any other professional advice.

3. Not Investment Advice

THE INFORMATION PROVIDED THROUGH THE SERVICE, INCLUDING BUT NOT LIMITED TO TRADING SIGNALS, MARKET INDICATORS, STRATEGY BACKTESTING RESULTS, INTELLIGENCE BRIEFS, AND ANY OTHER DATA OR ANALYSIS ("CONTENT"), IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY.

ALEPH TERMINAL IS NOT A BROKER, DEALER, FINANCIAL ADVISOR, INVESTMENT ADVISOR, PORTFOLIO MANAGER, OR TAX ADVISOR. NO CONTENT CONSTITUTES A RECOMMENDATION OR SOLICITATION TO BUY, SELL, OR HOLD ANY CRYPTOCURRENCY, TOKEN, DERIVATIVE, OR OTHER FINANCIAL INSTRUMENT.

YOU SHOULD NOT MAKE ANY INVESTMENT DECISION BASED SOLELY ON INFORMATION PROVIDED BY THE SERVICE. ALWAYS CONDUCT YOUR OWN RESEARCH AND CONSULT WITH A QUALIFIED FINANCIAL PROFESSIONAL BEFORE MAKING INVESTMENT DECISIONS.

4. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. You represent that you are not:

• Located in, or a resident of, any jurisdiction where use of the Service would be prohibited by law;
• On any sanctions list maintained by OFAC, the EU, or the UN;
• Using the Service on behalf of any sanctioned entity.

The Service is not available to residents of the following jurisdictions: Cuba, Iran, North Korea, Syria, the Crimea, Donetsk, and Luhansk regions, and any other jurisdiction subject to comprehensive sanctions by OFAC, the EU, or the UN.

5. Account and Wallet Connection

You connect to the Service using a self-custodial cryptocurrency wallet or GitHub OAuth. Aleph Terminal does NOT have access to your private keys, does NOT custody your funds, and does NOT execute transactions on your behalf unless you explicitly configure and authorize such functionality through third-party integrations.

You are solely responsible for the security of your wallet, private keys, and authentication credentials.

6. Subscription and Payments

Paid subscription tiers are billed monthly or annually at the rates displayed at the time of purchase. All fees are non-refundable except as required by applicable law or as described in our Refund Policy. We reserve the right to change pricing with 30 days' notice.

7. Strategy Marketplace

Users who publish strategies on the marketplace ("Strategy Providers") represent and warrant that:

• Their strategies are algorithmic tools and templates, NOT investment advice;
• They have the right to distribute such strategies;
• Past performance shown in backtests does NOT guarantee future results;
• They comply with all applicable laws in their jurisdiction.

Aleph Terminal acts solely as a platform facilitating the distribution of strategy templates. We do not endorse, verify, or guarantee the performance of any strategy. Strategy Providers are independently responsible for compliance with all applicable laws, including securities regulations in their jurisdiction.

8. Copy Trade / Signal Following

The "Copy Trade" feature displays target entry/exit ranges derived from algorithmic models. This is INFORMATIONAL DATA, not a trading recommendation. Use of signal-following features is entirely self-directed.

Any decision to execute a trade based on displayed targets is YOUR SOLE DECISION AND RESPONSIBILITY. You acknowledge that:

• Algorithmic signals can and do produce losses;
• Past signal performance does not guarantee future results;
• Market conditions can change rapidly and signals may not reflect current conditions;
• You may lose some or all of your invested capital.

9. Assumption of Risk

CRYPTOCURRENCY TRADING INVOLVES SUBSTANTIAL RISK OF LOSS. YOU ACKNOWLEDGE AND AGREE THAT:

• Cryptocurrency markets are highly volatile and unpredictable;
• Leveraged trading amplifies both potential gains and losses;
• You may lose your entire investment;
• Algorithmic models are based on historical data and may not predict future market movements;
• Technical failures, API outages, and network congestion may prevent timely execution of trades;
• Regulatory changes may affect the legality or availability of certain trading activities;
• Smart contract and protocol risks exist on all blockchain networks.

YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.

10. Prohibited Uses

You may not:

• Redistribute, resell, or commercially exploit any signals or data without written permission;
• Use the Service for market manipulation, wash trading, or any illegal activity;
• Attempt to gain unauthorized access to the Service or its systems;
• Use bots or automated tools to scrape data from the Service beyond API rate limits;
• Circumvent subscription restrictions or share account access;
• Use the Service for money laundering or terrorist financing;
• Circumvent geographic restrictions or sanctions.

11. Intellectual Property

All proprietary algorithms, models, signals, data processing methods, and software comprising the Service are the intellectual property of Aleph Terminal. You may not reverse-engineer, decompile, or attempt to extract the source code or underlying algorithms.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALEPH TERMINAL AND ITS OPERATORS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
• ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES;
• ANY TRADING LOSSES INCURRED BASED ON INFORMATION FROM THE SERVICE;
• ANY INTERRUPTION, DELAY, OR FAILURE OF THE SERVICE.

OUR MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Aleph Terminal from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of any applicable law.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA OR SIGNALS WILL BE ACCURATE OR RELIABLE.

15. Third-Party Services

The Service may integrate with third-party platforms (Binance, Hyperliquid, etc.) for data. We are not responsible for the availability, accuracy, or security of third-party services. Your use of such integrations is subject to those platforms' own terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Hong Kong SAR. Any disputes shall be resolved through binding arbitration under Hong Kong International Arbitration Centre (HKIAC) rules, except that either party may seek injunctive relief in courts of competent jurisdiction.

CLASS ACTION WAIVER: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

17. Severability

If any provision is found unenforceable, the remaining provisions continue in full force and effect.

18. Modifications

We may modify these Terms at any time by posting updated Terms on the Service. Material changes will be communicated via the Service or email with 30 days' notice. Continued use after modifications constitutes acceptance.
